Adoption Assistance Programs

Adoption benefits may include financial assistance, reimbursement of adoption-related expenses, and paid or additional unpaid leave beyond what the Family and Medical Leave Act requires. More U.S. companies are expanding adoption benefits to remain competitive, with many large employers offering up to $5,000 in financial support and around five weeks of paid time off. These benefits not only help attract and retain employees but also promote a family-friendly image and create equity between adoptive and biological parents. Employers and employees may also receive tax benefits, as defined under Internal Revenue Code Section 23(a), which covers qualified adoption expenses such as legal fees, court costs, and necessary adoption services. Qualified expenses cannot involve surrogate arrangements, violations of law, or adoption of a spouse’s child. Eligible children are under 18 or unable to care for themselves due to disability. Foreign adoptions are excluded unless finalized.
